CONTRACT/PUBLISHING POLICY INFORMATION

  1. All advertising is subject to the publisher's approval. The publisher reserves the right to reject advertising that is not in keeping with the publication's standards at his sole judgment and discretion.

  2. The publisher is dedicated to the pursuit of human rights, dignity and opportunity for all people. Accordingly, advertiser warrants that it does not discriminate in recruitment or employment on the basis of gender, race, religion, sexual orientation, national origin, creed, handicap or disability.

  3. Cancellations or changes in orders are not accepted after advertising closing date. None may be considered unless in writing, and none will be executed unless acknowledged and agreed to by the publisher.

  4. The publisher's liability for any error will not exceed the charge for the advertisement in question. The publisher assumes no liability if for any reason it becomes necessary to omit an advertisement.

  5. Publisher is not liable for delays in delivery and/or non-delivery in the event of an Act of God, action by any government or quasi-governmental entity, fire, flood, insurrection, riot, explosion, embargo, strikes whether legal or illegal, labor or material shortage, transportation interruption of any kind, work slowdown, or any condition beyond the control of the publisher affecting publication or delivery in any manner.

  6. Agency commission is 15% of gross billing payable to recognized agencies, provided account is paid within 30 days of invoice date. No discounts are to be taken or provided after 30 days of invoice date.

  7. Special ad supplement discounted rates are non-commissionable.

  8. Conversion of materials to camera-ready art and typesetting charges will be billed at 20% above publisher's cost.

  9. Publisher reserves the right to hold advertiser and/or its advertising agency jointly and severally liable for such monies as are due and payable to the publisher.

  10. All materials will be stored for one year after the most recent use and then destroyed, unless the publisher is otherwise advised in writing by the advertiser or agency.

  11. The New Physician will not be bound by any conditions whatsoever appearing on order blanks or copy instructions submitted by or on behalf of the advertiser when such conditions conflict with any provision contained in its rate card or with its policies.

  12. Advertiser and advertising agency agree to indemnify, defend and save harmless the publisher from any and all liability for content (including text, illustrations, representatives, sketches, map, trademarks, labels or other copyrighted matter) or advertisements printed or the unauthorized use of any person's name or photograph arising from the publisher's reproduction and publishing of such advertisements pursuant to the advertiser's or agency's order. The publisher reserves the right to reject, discontinue or omit any advertising or any part thereof at any time. This right shall not be deemed to have been waived by acceptance or actual use of any advertising matter.
